Terms Of Service!

Welcome! When using NHD's website and/or products, you agree to the terms and conditions listed on this page (the "Terms of Service"), which may be updated by us from time to time. You can check out the most current version of these Terms of Service by clicking on the Terms Of Service link in the footer on any of NHD's web pages.

Terms Of Service definitions:
NHD will use "you", "your" as meaning the customer, visitor, user, or the buyer of a product from NHD's web site, and "Freeware", "CD-ROM", "CAD Projects" meaning the products that we sale or service we provide on our web site and "we", "us", "our", and NHD as meaning Nerd House Designs the owner of the products which is for sale or services we provide, and "their", "host" meaning the server company which is providing the space on the internet for NHD's website. Furthermore "Linked Sites" will refer to website outside NHD's control where we get our links to provide the freeware, and/or our affiliated links. Where "affiliated links" will mean a web site that we have some type of agreement with to place an advertisement on Our website in means of making NHD Money.

Our site may contain links to other websites, news media, affiliated links, or other resources that we provide for your convenience ("Linked Sites"). These sites are not under the control of NHD, and NHD is not responsible for the content available on any Linked Site. Such links do not imply NHD's endorsement of material on any Linked Site and NHD expressly disclaims all liability with regard to your access to such Linked sites. Access to any other websites linked to the sites is at your own risk.

Our site may contain links to download computer software known as Freeware, we make sure all are suggested Freeware is free of any spyware or adware before We recommend it to our user. Since we do not host nor control how the Freeware is stored or created you agree not to hold Us responsible for any damage or harm that a download may cause you computer. If you purchase a CD-ROM We guarantee that Our CD's will be virus free, As with downloading Freeware from the internet you agree not to hold us at fault for any damage that any given freeware from the CD may cause to your computer, we only provide the freeware and do not control how it is written. If the freeware program cause damage to you computer feel free to contact Us describing the problem and what program caused it, and We will get you in touch with the creator of the freeware.

Our Product For Sell

NHD has the right to offer specials and discounts to any organization, businesses, personal groups or private individuals as we feel fit. NHD has the right to change our prices without any written or prior notification to our customers. If you have sent us a payment on for a CD-ROM or CAD Project and we raise/lower prices, the price you paid prior to the price change will remain valid, we will not charge you more nor give you the difference back if you paid more then the new price change. ALL SALES ARE FINAL!

Our CAD Projects

You understand that NHD only provides CAD Projects to private individual, We design simple CAD Drawing and create a "pdf" file in which you may purchase. These CAD Projects are created using Alibre Design, ProgeCAD LT 2006, or SoftCAD.3D Lite and converted into a "pdf" file. You agree that you will use the "pdf" file for your sole personal use and not resale it or repost it as "Freeware" on the internet, nor will you sell it as a computer disk, CD, or DVD. When you purchase Our CAD Projects you buy the right to use the "pdf" for personal use only any other uses will be viewed as breaking these Terms Of Service which you agreed upon when you purchased our CAD Projects.

When you order one of Our CAD projects, you agree to pay NHD using PayPal, and agree to their terms during the transaction. Paypal controls Our shopping cart and collects all the payment information, any infringement on paypal's part with your personal information, you agree not to hold NHD at fault.

Our Freeware CD-ROM's

You agree when purchasing a Freeware CD-ROM that the software provided on the CD-ROM is "Riskware", which means you can install at your own risk. You agree that NHD and it's affiliated links are not responsible for any harm done to your computer by any program on the CD-ROM, installed by you or another party, may cause. You agree to the purchase of the CD-ROM therefore you are not buying the freeware but purchasing my time for creating the CD-ROM and the blank CD-ROM itself. We never charge for the freeware. We provide you with the best adware/spyware free software that we can find on the internet. Our CD-ROM's will never contain a virus we run a detailed scan on our computer before we create your CD-ROM. We do not offer any technical support for any of the software in the Big List or on the CD-Rom's. Any Technical support should be directed to the creator of the Freeware program.

Payment Notice!

NHD will not send out our CD-ROM's to you without receiving your payment. When we receive a payment notice from Paypal we will send out your order the next business day. We are not responsible for lost or stolen checks, credit card information given on paypal's web site. You agree not to hold NHD or it's affiliated links responsible for lost, cracked, or broken CD-ROM's. We send all our CD-ROM's needing a valid signature to track the package, this assure us that you received the CD-ROM, If the CD-ROM gets cracked, scratched or broken during shipping return it to us with 1 week and we will be happy to replace it free of charge.

Downloaded Software

Our Desktop Themes

Our Desktop Themes Our Freeware and provided as "use at you own risk", we never add spyware/adware to our Desktop Themes. You agree that you will not sell or repost any of NHD's Desktop Themes any where on the internet with out our written consent.

Changes to Terms Of Service

NHD reserves the right to change or amend these Terms Of Service at any time and without prior notice. By purchasing our products and viewing our web pages, you are in agreement to these Terms Of Service which are located at our web site. At the customers request we will email any changes to these Terms Of Service.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by NHD, Nerd House Designs, or David Huston.
